			<content:encoded><![CDATA[<p>The people who own EMI Music Group <a href="http://mediamemo.allthingsd.com/20091117/when-will-warner-music-group-finally-buy-emi/">may regret the purchase</a>, but here&#8217;s a tiny bit of good news: Sales are creeping up, even as the rest of the business contracts.</p>
<p>The company&#8217;s revenue climbed 7.4 percent in the 12 months ending March 31, the company disclosed (via <a href="http://paidcontent.org/article/419-emi-finds-music-sales-actually-growing-despite-terras-troubles/">PaidContent</a>).</p>
<p><a rel="lightbox" href="http://mediamemo.allthingsd.com/files/2009/11/emi-2009.png"><img class="alignnone size-full wp-image-13196" title="emi 2009" src="http://mediamemo.allthingsd.com/files/2009/11/emi-2009.png" alt="emi 2009" width="499" height="224" /></a></p>
<p>That&#8217;s due to both increases in the sale of recorded music and publishing revenue; increases in the former are particularly rare these days. And those numbers ought to bump again in the coming year, since they&#8217;ll included dollars/pounds generated by the re-release of the Beatles albums.</p>
<p>Alas, since EMI owner Terra Firma is deep in the midst of negotiations with Citigroup (C), which lendt it billions to buy the company, it&#8217;s not handing out any other details about the company&#8217;s performance, so hard to tell what&#8217;s really going on there.</p>
<p>Still, we do know that music has been in decline for a decade, and EMI&#8217;s bump up is the first, no matter how modest, in many moons.</p>

<p>But Spotify has yet to make a key expansion: To the U.S., where the big music labels worry that consumers will love everything about the site except paying for it. That&#8217;s bad, since Spotify is supposed to work best as a subscription service.</p>
<p>Most Americans have never heard of Symbian, but it remains the biggest player in the global smartphone market (as long as you use a broad definition of smartphone). But it&#8217;s telling that Spotify first made a point of making its service compatible with Apple&#8217;s iPhone (AAPL) and Google&#8217;s Android (GOOG) handsets first.</p>
<p>In any event, Spotify is only available via mobile to paying subscribers, who shell out around $16 a month in the UK (and less in some other countries). They key question for the music business is how many of those there are.</p>
<p>Spotify won&#8217;t release any statistics, but one number that I&#8217;ve heard from people close to the company is 100,000, which works out to be less than 2 percent of the company&#8217;s overall user base (free users can only listen to the service on their PCs, and have to endure a small smattering of ads). But US music industry executives worry that the number may be even lower than that.</p>
<p>The two sides continue to chat, and conventional wisdom is that the service will indeed get to the US, one day. But at one point Spotify was talking about coming to America in 2009, and that looks just about impossible at this point. Now CEO Daniel EK is talking about the <a href="http://www.billboard.biz/bbbiz/content_display/industry/e3ib1f5c256ca1b29dddec1bbfec3ea293d">first half of 2010</a>.</p>

			<content:encoded><![CDATA[<p>Terrifying? Inevitable? Harbinger? In any case, it&#8217;s a first: Police in Long Island, New York, have arrested a man for <em>not</em> using Twitter.</p>
<p>Someone named Justin Bieber, who apparently is a teenage singer, was supposed to appear at the Roosevelt Field mall on Friday, but stayed away because the crowd had become too unruly. Police asked a record label executive to help disperse the horde using the messaging service, and claim he didn&#8217;t cooperate. More from <a href="http://www.newsday.com/long-island/nassau/aggressive-roosevelt-field-crowd-cancels-bieber-visit-1.1613741">Newsday</a>:</p>
<blockquote class="memo"><p>Police arrested a senior vice president from Bieber&#8217;s label, Island Def Jam Records, James A. Roppo, 44, of Hoboken, N.J., saying he hindered their crowd-control efforts by not cooperating.</p>
<p>He was in custody Friday night, pending charges that could include criminal nuisance, endangering the welfare of a minor and obstructing government administration, Smith said.</p>
<p>&#8220;We asked for his help in getting the crowd to go away by sending out a Twitter message,&#8221; Smith said. &#8220;By not cooperating with us we feel he put lives in danger and the public at risk.&#8221;</p></blockquote>
<p>Slightly confusing, because Bieber&#8217;s Twitter account&#8211;presumably the one the cops wanted Roppo to use&#8211;does indeed show that he asked his fans to leave at <a href="http://twitter.com/justinbieber/status/5900977561">4:30 pm Eastern</a>:</p>

It is paying a fire-sale price of $1 million, sources familiar with the situation tell me, and could pay up to $7 million to $9 million in earn-outs for key employees, who will likely include CEO Dalton Caldwell.</p>
<p>For the record, the deal theoretically values Imeem at something like $8 million, but most of that comes in the form of accounts receivable and debt obligations, and isn&#8217;t relevant to MySpace, which won&#8217;t be dealing with that stuff. And it&#8217;s not relevant to investors like Sequoia and Warner Music Group (WMG), which pumped at least $25 million into the venture.</p>
<p>In retrospect, <a href="http://mediamemo.allthingsd.com/20090507/warner-music-group-walks-away-from-digital-startups-lala-imeem-and-loses-33-million/">Warner&#8217;s move to write off all of its Imeem investment</a> in May was 100 percent accurate.</p>
<p>In September, I visited Caldwell in his San Francisco office. He looked like a guy who has had a very hard year, but he was confident that the company had gotten through the worst of it. If Imeem executed on plan, he argued, it would be able to survive. It wouldn&#8217;t be a home run, but it could at least sustain itself&#8211;no mean feat for a digital music start-up.</p>
<p>So what happened? &#8220;Things can change very quickly,&#8221; a person familiar with the company&#8217;s story told me yesterday. The short version of the story is that Imeem quickly and unexpectedly ran out of cash. Here&#8217;s the longer version of that story, which I&#8217;ve pieced together from various sources:</p>
<ul>
<li>As <a href="http://gigaom.com/2009/11/17/why-imeem-really-sold-out/">Om Malik reported</a>, the company was hit with a copyright lawsuit by music publisher Orchard Enterprises (ORCD). Fighting the suit or settling it would require significant resources.</li>
<li>Efforts to raise another funding round fell flat. If you want, you can blame the fact that Sequoia declined to pour more money into the company, which acted as a blinking red warning light for other potential investors. Or you could point to the fact that Web music start-ups of all stripes have been flailing for a couple of years.</li>
<li>Ad sales, which had been perking up throughout the year, fell short of Q4 targets.</li>
<li>All of the above meant that Imeem was struggling to meet payroll and payments on its debt, which it racked up when it built out its own content-delivery network.</li>
</ul>
<p>So in retrospect, it&#8217;s easy to see why the company sold: It had no choice. And it&#8217;s sort of easy to see why News Corp.&#8217;s (NWS) MySpace bought Imeem: It&#8217;s hard to pay less for talent.</p>

			<content:encoded><![CDATA[<p>It&#8217;s official: You still can&#8217;t buy the Beatles&#8217; songs on the Web, despite the efforts of a site that attempted to do so by rewriting copyright law on the fly.</p>
<p>A Los Angeles federal judge has issued a preliminary injunction against BlueBeat, a California-based site that had briefly sold the band&#8217;s music, arguing it used &#8220;psycho-acoustic simulation&#8221;&#8211;basically, making a note-for-note recording of the band&#8217;s recordings&#8211;to make the songs its own.</p>
<p>The same judge had already issued a <a href="http://www.wired.com/epicenter/2009/11/bluebeat-claims-to-own-new-copyrights-to-old-beatles-songs/">temporary restraining order</a> on behalf of music label EMI Music Group against the site earlier in the month and had scheduled a hearing for Friday, Nov. 20. But this ruling cancels out the hearing and by any reasonable standard should end the case.</p>
<p>Then again, this whole story has been a head-scratcher from the start, so who knows? Maybe the BlueBeat guys will try an even more preposterous argument down the road.</p>
<p>Part of me thinks that the whole thing may be some sort of <a href="http://en.wikipedia.org/wiki/Negativland#The_U2_record_incident">Negativeland/U2</a> hack/stunt/performance art piece. Or maybe there were a lot of mood-altering substances involved. Or maybe it&#8217;s part of a conspiracy to create work for copyright lawyers.</p>

The site, which is co-owned by Vivendi&#8217;s Universal Music Group, Sony&#8217;s (SNE) music label and <a href="http://mediamemo.allthingsd.com/20091019/vevo-gets-its-investor-abu-dhabi-media-joins-hulu-for-music-videos/">Abu Dhabi Media</a>, will host a New York kick-off event that day.</p>
<p>For those who haven&#8217;t been following along, here&#8217;s what we know about Vevo:</p>
<ul>
<li>It will be powered by Google&#8217;s (GOOG) YouTube, which will share ad revenue with the joint venture.</li>
<li>It is being run by <a href="http://mediamemo.allthingsd.com/20090508/vevo-aka-youtube-music-gets-a-ceo-universal-digital-boss-rio-caraeff/">Rio Caraeff</a>, Universal&#8217;s veteran digital guy.</li>
<li>In addition to its equity partnership, its distribution strategy is modeled after Hulu: Sony and Universal videos will appear exclusively on the site and/or YouTube, but the site plans on licensing its stream to other outlets, as Hulu does with portals like MySpace and Comcast&#8217;s (CMCSA) Fancast. One obvious place to license the stuff: Hulu itself.</li>
<li>Neither EMI nor Warner Music Group (WMG), <a href="http://mediamemo.allthingsd.com/20090928/how-the-youtube-warner-music-deal-got-done-meet-vevo-jr/">which has created its own Vevo-like channel with YouTube</a>, is participating in the venture, but they could.</li>

<p>But oddly, the deal is the only one of its kind. While the big music labels have played footsie with Hulu in the past, they have yet to actually move any of their clips there.</p>
<p>That could still happen one day, and the site <a href="http://bits.blogs.nytimes.com/2009/11/18/hulu-takes-first-step-into-music/">hints</a> that you may see more clips coming down the road. But Hulu is less valuable for the labels than it could have been a year ago: Since then, three of the big four have struck deals that give them much more incentive to show their stuff on Google&#8217;s (GOOG) YouTube, the world&#8217;s biggest video site.</p>
<p>Vivendi&#8217;s Universal Music and Sony (SNE) have a deal that locks up their stuff exclusively on Vevo, a sort of <a href="http://mediamemo.allthingsd.com/20090604/sony-joins-vevo-universals-hulu-for-music-videos/">&#8220;Hulu for music videos&#8221;</a> that will be powered by YouTube. And <a href="http://mediamemo.allthingsd.com/20090928/how-the-youtube-warner-music-deal-got-done-meet-vevo-jr/">Warner Music Group (WMG) has convinced YouTube</a> to give the label its own branded channel for its clips.</p>
<p>No word on financials for the Hulu deal, but I&#8217;d surprised if this generates much cash for EMI. Hulu&#8217;s core partners&#8211;News Corp.&#8217;s (NWS) Fox, GE&#8217;s (GE) NBC Universal and Disney&#8217;s (DIS) ABC&#8211;have deals that let them keep 70 percent of any ad revenue their stuff generates on the site. But other partners get closer to 50 percent.</p>
<p>In other Norah news, my soon-to-be sort-of neighbor is having <a href="http://www.nypost.com/p/news/local/brooklyn/neighbors_bash_norah_window_in_brick_jYuf3MMZy0GNU0pAD9fiEI">construction problems</a>. Here she is taking on one of the great Wilco songs:</p>

<p>That&#8217;s the obvious question in light of news that both Terra Firma, the private equity group that bought EMI in 2007, and Citigroup, which funded most of the transaction, have written down most of their investments in the music company.</p>
<p>This isn&#8217;t a surprise&#8211;<a href="http://mediamemo.allthingsd.com/20090302/emis-owners-suffer-a-16-billion-case-of-buyers-remorse/">the move has been a long time coming</a>&#8211;but it does open the door for <a href="http://mediamemo.allthingsd.com/20090520/warner-music-doubles-up-on-debt-another-emi-bid-coming/">Warner, which restructured its debt</a> with an eye toward making such a deal earlier this year.</p>
<p>Pali Research&#8217;s <a href="http://paliresearch.com/2009/11/17/how-long-can-emi-remain-independent-warner-waiting-to-pounce/">Rich Greenfield</a> thinks that Citi (C) will push to break up EMI and sell Warner (WMG) the record music group, which tends to lose money, and keep the music publishing business, which has been a reliable money maker, even during the industry&#8217;s 10-year freefall.</p>
<p>But at this point, I don&#8217;t know why Warner couldn&#8217;t try to swallow the whole thing. In the past, that deal would have been scuttled due to antitrust issues (and in fact, it <a href="http://money.cnn.com/2006/07/12/commentary/mediabiz/index.htm">was</a>), but the music industry is a different beast right now&#8211;a sick beast&#8211;and I think regulators would be a lot more forgiving this time around.</p>

<p>The deal, which isn&#8217;t finalized, was first reported by <a href="http://www.techcrunch.com/2009/11/16/myspace-close-to-acquiring-imeem/">TechCrunch</a>.</p>
<p>Once it&#8217;s finished, it will conclude an up-and-down year for Imeem, in which the service pleaded with the major music labels, successfully, <a href="http://mediamemo.allthingsd.com/20090327/imeem-asks-big-music-for-help-gets-some-needs-more/">to change the terms of its music licensing deals</a>, which were killing the streaming music site. But that wasn&#8217;t enough to prevent investor <a href="http://mediamemo.allthingsd.com/20090507/warner-music-group-walks-away-from-digital-startups-lala-imeem-and-loses-33-million/">Warner Music Group (WMG) from writing off the money</a> it had sunk in the service (though <a href="http://mediamemo.allthingsd.com/20090615/exclusive-warner-music-group-gets-back-together-very-cautiously-with-imeem/">Warner later ended up increasing its stake in the service</a> without actually writing another check).</p>
<p>Like other Web music services that sprang up in the past few years, Imeem wanted to provide users with free tunes, and pay the licensing fees by selling advertising against its user base. But the economics for that proposition appear unworkable: The labels, who are afraid that giving away music on the Web will kill any chance they have of selling the stuff, are reluctant to cut their fees substantially, and ad dollars for music sites have been relatively hard to come by.</p>
<p>That dynamic is still causing problems for MySpace&#8217;s own music service, one of the few remaining sites offering free streams. It will be interesting to see how that company is affected by <a href="http://mediamemo.allthingsd.com/20091021/google-steps-gingerly-into-music-with-one-box/">&#8220;OneBox,&#8221; </a>the new Google (GOOG) search feature which provides free streams for searchers, then directs them to MySpace and LaLa, one of the other surviving services.</p>

<p>For what it&#8217;s worth, my money&#8217;s on the Forrester number, or one that&#8217;s even lower. My gut says people love consuming news, but only in the broadest sense&#8211;<a href="http://digitaldaily.allthingsd.com/20091116/qotd-213/">Obama doesn&#8217;t really Twitter!</a> <a href="http://sports.yahoo.com/nfl/recap?gid=20091115011">What was Belichick thinking?</a>&#8211;and that sort of stuff, which appeals to a very large audience, will always be free, and you&#8217;ll get it from Google (GOOG) or something like Yahoo (YHOO). Which leaves you with a small audience willing to pay for everything else.</p>
<p>But! We should note that people are indeed paying for &#8220;content&#8221; right now. In fact, they&#8217;re paying for a lot of it: $115 a month, up seven percent from last year, says NPD Group. The breakdown:</p>
<blockquote class="memo"><p>As of August 2009, 81 percent of U.S. households subscribed to a television service (satellite TV, basic/premium cable, or fiber-optic television service). A similar percentage of households (76 percent) paid for Internet subscriptions. Seventeen percent subscribed to an online music service or satellite radio; and 14 percent subscribed to online gaming subscription services.</p>
<p>More traditional forms of entertainment subscriptions, however, did not fare so well. The number of people subscribing to newspapers fell by 2 percentage points to reach 29 percent in August 2009. Forty-one percent of consumers subscribed to magazines this year, compared to 43 percent who did so last year.</p>
<p>According to NPD, an influx of new smartphone owners has led to an increase in mobile data-plan subscriptions: 9 percent of U.S. consumers had mobile data subscriptions this year, versus just 6 percent last year. Fourteen percent of consumers subscribed to a home-video subscription service, like Netflix, this year, which is 2 percentage points higher than last year.</p></blockquote>
<p>Ah, see? Problem solved: If you want Americans to pony up for stuff on the Web, just link it to something they&#8217;re already paying for, like their cable or Internet subscription.</p>
<p>This is what smart guys like <a href="http://d7.allthingsd.com/speakers/john-malone/">John Malone</a> have been talking about for a while, and it&#8217;s also the core of the strategy behind the Time Warner (TWX)/Comcast (CMCSA)/everyone else &#8220;TV Everywhere&#8221; gambit. But it&#8217;s also what many people have been trying to do for a very long time&#8211;ask the music industry&#8211;with limited success.</p>

<p>The takeaway: The site is losing traffic and money and no longer expects to get all of the $900 million it once counted on from a Google search deal. Also, the company really doesn&#8217;t know what to expect of the property going forward, except that it&#8217;s a work in progress.</p>
<p>So: Either digital media boss Jon Miller, MySpace CEO Owen Van Natta and the rest of the new team brought in this year to fix the site have an impossible task or expectations are now so low that even modest improvement will look like a huge victory.</p>
<p>Details from the earnings call, which <a href="http://mediamemo.allthingsd.com/20091104/news-corp-delivers-inline-revenues-and-an-earnings-bump/">I covered live this afternoon</a>:</p>
<ul>
<li>Revenue was down 26 percent at Miller&#8217;s Digital Media Group (MySpace and a handful of other sites).</li>
<li>That&#8217;s in part because conventional ad revenue is down and in part because search ad revenue is down.</li>
<li>But isn&#8217;t Google (GOOG) supposed to be paying $900 million over three years in a search deal? Yes, but only if News Corp. (NWS) hits certain traffic/query guarantees, which isn&#8217;t happening anymore, says Murdoch.</li>
<li>How much is MySpace going to miss by? This question occasions much confusion on the call. &#8220;I don&#8217;t know. But it will be a real figure,&#8221; Murdoch says. Then he throws out the number $300 million. His lieutenants suggest that it&#8217;s closer to 10 percent, or $90 million. I&#8217;ve since checked with News Corp. PR, which says the figure is &#8220;in the 100 [million] zone for the year.&#8221;</li>
<li>So what&#8217;s the plan to fix all of this? &#8220;It&#8217;s a work in progress,&#8221; News Corp. officials say over and over during the call. Chase Carey, Murdoch&#8217;s new number two, uses the phrase at least three times in one answer.</li>
<li>Any other color on overhaul plans? Nothing you haven&#8217;t heard before: The company is trying to become an entertainment portal instead of a social network. Carey: &#8220;We’re not trying to beat Facebook. We’re not trying to beat Twitter.&#8221;</li>

<p>That&#8217;s the pitch Apple has been making to TV networks in recent weeks. The company is trying to round up support for a monthly subscription service that would deliver TV programs via its multimedia software, multiple sources tell me.</p>
<p>Apple (AAPL) isn&#8217;t tying the proposed service to a specific piece of hardware, like its<a href="http://digitaldaily.allthingsd.com/20091029/new-from-apple-apple-tv-3-0/"> underwhelming Apple TV box</a> or its long-rumored tablet/slate device. Instead, the company is presenting the offer as an extension of its iTunes software and store, which already has <a href="http://digitaldaily.allthingsd.com/20090909/live-from-apples-lets-rock-event-itunes-9/">100 million customers</a>.</p>
<p>A so-called &#8220;over the top&#8221; service could <a href="http://digitaldaily.allthingsd.com/20090820/apple-triple-play-itunes-app-tv-and-apple-television/">theoretically rival the ones most consumers already  buy from cable TV operators</a>&#8211;if Apple is able to get enough buy-in from broadcast and cable TV programmers.</p>
<p>That&#8217;s a big if: Apple has told industry executives it wants to launch the service early next year, but I have yet to hear of a single programmer that has made a firm commitment to the company, which has tasked iTunes boss Eddy Cue with promoting the idea.</p>
<p>Industry executives believe that if anyone jumps first, it will be Disney (DIS), since CEO Bob Iger has shown a willingness to experiment with Apple and iTunes in the past: In 2005, Disney was the first player to sell its programming on iTunes, via a-la-carte downloads. And Apple CEO Steve Jobs is Disney&#8217;s largest single shareholder, a result of Disney&#8217;s 2006 acquisition of Jobs&#8217;s Pixar animation studio. Apple didn&#8217;t respond to requests for comment.</p>
<p>Network executives I&#8217;ve talked to are intrigued by the idea&#8211;they are eager to find new revenue streams&#8211;but are also wary, for several reasons.</p>
<p>Cable networks, for instance, don&#8217;t want to threaten existing relationships and subscription fees from cable providers like Comcast (CMCSA). And programmers are also worried about the effect a subscription service would have on advertising revenue: Even if the service didn&#8217;t distribute TV programs until after their initial air date, that could cut into ratings, which now measure viewership over the course of several days.</p>
<p>But the move to deliver TV and movies over the Web is already well under way. Netflix (NFLX), for instance, already bundles free streaming movie and television along with its disc-by-mail subscription service. iTunes and Amazon (AMZN) rent movies on a one-off basis, and Google&#8217;s (GOOG) YouTube is trying out the same thing. Meanwhile, Hulu, the joint venture between GE&#8217;s (GE) NBC, News Corp.&#8217;s (NWS) Fox, and ABC, is figuring out how to launch a paid service that may include rentals, paid downloads or subscriptions.</p>
<p>So Apple&#8217;s proposed subscription service, which the company has floated in the past, is no longer a huge stretch. Says one executive briefed on the company&#8217;s plans: &#8220;I think they might get it right this time.&#8221;</p>

<p>You get a lot of video streams. <a href="http://www.variety.com/article/VR1118010544.html?categoryid=1009&amp;cs=1&amp;nid=2562&amp;utm_medium=twitter&amp;utm_source=twitterfeed">Close to 10 million</a>, says YouTube, adding that Sunday&#8217;s live Webcast of U2&#8217;s Rose Bowl concert was the single largest event it has streamed so far.</p>
<p>Granted, Google&#8217;s (GOOG) video site only started streaming live events last year, and doesn&#8217;t do them very often. But this was a pretty good muscle-flexing event, and by all accounts it went pretty well&#8211;I read some gripes about the site limiting transfer speeds, but many more raves about the quality of picture and sound.</p>
<p>That 10 million number, spread out over two-plus hours, doesn&#8217;t really tell us how many people watched the concert or how many did so concurrently. YouTube&#8217;s first attempt at live streaming, its weird <a href="http://mediamemo.allthingsd.com/20081123/youtubes-big-live-debut-pretty-small/">&#8220;YouTube Live&#8221; concert/award show</a>, may have attracted a peak audience of 700,000.</p>
<p>For some context, consider that last week&#8217;s episode of &#8220;The Mentalist&#8221; on CBS (CBS) drew 11.8 million viewers, which made it the 20th-ranked show in the U.S. But the fact that YouTube is even playing in the same league gives you a sense of the site&#8217;s reach.</p>
<p>And recall that YouTube boasted this month that it is now <a href="../20091009/the-secret-of-chad-hurley-and-steve-chens-famous-two-kings-video-revealed/">streaming more than one billion streams per day</a>, which means that the overwhelming majority of its users were watching something <em>other</em> than Bono and company on Sunday.</p>
<p>You can see an amazingly high-quality version of the concert <a href="http://www.youtube.com/u2official#p/u/">here</a>, though it isn&#8217;t embeddable. But here&#8217;s a clip of a fake U2 concert from a couple of years ago.</p>

<p>This time, though, they&#8217;re not trying to convince consumers to pay for music or asking advertisers to subsidize it. Instead, they&#8217;re trying to act as a middleman between labels and publishers who own music and advertisers, Hollywood and other folks who want to use the tunes for commercial purposes.</p>
<p>Via Twain Media, their personal investment company, Goldberg and Roback have purchased a smallish start-up called mSoft and renamed it <a href="http://dashbox.com/home">Dashbox</a>, which they describe as a <span style="letter-spacing: 0px;">&#8220;subscription service that aggregates and manages all of your production music and sound effects.&#8221;</span> The idea is to link up people who need to buy music for commercial reasons with rights holders, who are often scattered and hard to track down.</p>
<p>Roback will take the CEO spot at the renamed company; Goldberg, who has a day job running SurveyMonkey, will be chairman. The company hasn&#8217;t disclosed the terms of its mSoft purchase, but people familiar with the transaction tell me they bought the company for under $10 million.</p>
<p>Roback and Goldberg founded Launch Media in 1994, and sold it to Yahoo (YHOO) in 2001; the two stayed on to run Yahoo Music until 2007. Earlier this year, <a href="http://kara.allthingsd.com/20090420/former-yahoo-music-exec-dave-goldberg-to-head-survey-monkey/">Goldberg invested in and took over SurveyMonkey</a>, an online survey coordinator.</p>
<p>Goldberg is one of many former digital music executives I&#8217;ve talked to who thinks the music business is fundamentally broken, so at first blush it&#8217;s a tiny bit surprising to see him back in it again.</p>
<p>But he and Roback are essentially investing in an entirely different industry&#8211;it&#8217;s a business-to-business market that really hasn&#8217;t been affected much by the digital revolution. If you want to use a song in your TV show, you can&#8217;t steal it via BitTorrent or stream it for free on Spotify.</p>
<p>Nor has the digital revolution affected the industry&#8217;s infrastructure, which remains pretty ancient. Music supervisors for TV shows and movies still end up resorting to faxes and phone calls to track down tunes they&#8217;d like to use.</p>
<p>So there are some obvious opportunities for someone who can amass scale and decrease friction here. It may not be as sexy as providing consumers with all the free music they want, but it may end up being more profitable.</p>
